By accessing dogabot (the "Platform"), owned and operated by Petrin Bertini Engineering ("the Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. Your continued use of the Platform constitutes acceptance of any modifications to these Terms.

2.1 Basic Requirements

You must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into binding agreements. By using dogabot, you represent and warrant that:

• You meet the age and legal capacity requirements
• You are not prohibited from using financial services under applicable laws
• All information you provide is accurate and complete

2.2 Prohibited Jurisdictions & Sanctions

You represent and warrant that you are not a citizen or resident of, and will not use the Platform from, any country or jurisdiction that is subject to comprehensive international sanctions (including but not limited to North Korea, Iran, Syria, Cuba, and the Crimea, Donetsk, and Luhansk regions). You further represent that you are not listed on any government list of prohibited or restricted parties.

dogabot is an international Software-as-a-Service (SaaS) platform offering technical tools for data visualization, portfolio management, and automated trade execution. The Platform:

• Is NOT a financial institution, broker, exchange, or investment advisor
• Does NOT provide investment, tax, legal, or financial advice
• Does NOT guarantee any trading outcomes or profits
• Is provided strictly as a technical automation tool

You should consult with qualified financial, tax, and legal professionals before making any investment decisions.

The Platform is strictly non-custodial. We do not hold, manage, control, or have access to your digital assets, funds, or private keys. You connect to third-party exchanges via API keys. You are solely and exclusively responsible for:

• Maintaining the security and confidentiality of your API keys
• Ensuring that "Withdrawal" permissions are DISABLED for all API keys connected to dogabot
• All trading activities and decisions made through the Platform
• Compliance with exchange terms of service and policies
• Any losses or damages resulting from compromised credentials

You acknowledge and agree that:

• All trading decisions and strategies are yours alone
• You will use the Platform in compliance with all applicable local, national, and international laws and regulations
• You will not engage in market manipulation, fraud, or any illegal activities
• You will not attempt to gain unauthorized access to the Platform or other users' accounts
• You are responsible for all tax obligations related to your trading activities
• You will not use the Platform if trading is prohibited in your jurisdiction

IMPORTANT: USE OF THE PLATFORM TO MANAGE THIRD-PARTY CRYPTOCURRENCY HOLDINGS WITHOUT PROPER LICENSING IS STRICTLY PROHIBITED.

6.1 Prohibition on Unlicensed Asset Management

Unless you are a duly licensed and regulated financial professional, investment advisor, or asset manager in your jurisdiction, you are strictly prohibited from:

• Using the Platform to manage, control, or trade on behalf of other individuals or entities
• Connecting API keys that belong to or control assets of third parties
• Operating as an unlicensed investment advisor or fund manager
• Soliciting or accepting funds from others to trade using the Platform

6.2 Licensed Professional Use

If you are a licensed financial professional (e.g., registered investment advisor, asset manager, or equivalent in your jurisdiction) and wish to use the Platform to manage client accounts, you represent and warrant that:

• You hold all necessary licenses, registrations, and authorizations required in your jurisdiction
• You maintain full compliance with all applicable financial services regulations
• You have obtained proper written authorization from each client
• You independently verify that your use of automation tools complies with your regulatory obligations
• You maintain adequate professional liability insurance as required by your jurisdiction
• You do NOT hold or control client funds through dogabot (non-custodial only)

6.3 User Certification and Compliance

By using the Platform, you represent, warrant, and certify that:

• You are either trading your own personal assets OR you hold proper licenses to manage client funds
• You will immediately cease use if your licensing status changes or becomes invalid
• You understand that dogabot does not verify, validate, or monitor your licensing status
• You are solely responsible for compliance with all applicable securities, commodities, and financial services regulations

6.4 No Verification of Licensing

dogabot does NOT verify, validate, or monitor whether you hold appropriate licenses or comply with financial services regulations in your jurisdiction. We do not endorse, recommend, or facilitate any particular investment strategy or financial advisory service. You are solely responsible for:

• Determining whether you are legally permitted to use the Platform for your intended purpose
• Obtaining and maintaining all necessary licenses and registrations
• Ensuring compliance with all applicable laws and regulations

6.5 Reporting and Termination

If we become aware or suspect that you are managing third-party funds without proper licensing, we reserve the right to immediately suspend or terminate your account without notice or refund. We may also report such activity to relevant authorities if required by law.

Subscriptions are billed in advance on a recurring basis. You authorize Petrin Bertini Engineering to charge your chosen payment method for the selected plan. All fees are:

• Non-refundable except as stated in our Refund Policy
• Exclusive of applicable taxes, VAT, GST, or similar charges unless otherwise stated
• Subject to change with 30 days' advance notice
• Payable in the currency specified at the time of purchase

We do not guarantee uninterrupted or error-free service. The Platform is provided "AS-IS" and "AS AVAILABLE" without warranties of any kind. We reserve the right to:

• Modify, suspend, or discontinue any aspect of the Platform at any time
• Perform scheduled or emergency maintenance without prior notice
• Implement updates, changes, or improvements to the Platform
• Change features, functionality, or pricing structures

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Petrin Bertini Engineering, its officers, directors, employees, and affiliates shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Trading losses or loss of profits
• Loss of data or information
• System failures, bugs, or technical glitches
• API latency or exchange downtime
• Unauthorized access to your account
• Market volatility or adverse trading conditions
• Errors in automated strategies or executions

Our total liability shall not exceed the amount paid by you for the Platform in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Petrin Bertini Engineering, its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Platform
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your trading activities or decisions
• Any claims made by third parties related to your use of the Platform

The Platform integrates with third-party cryptocurrency exchanges and services. We are not responsible for:

• The availability, functionality, or security of third-party services
• Exchange downtime, API changes, or service interruptions
• Exchange fees, policies, or terms of service
• Actions taken by exchanges, including account suspensions or freezes

You are solely responsible for complying with the terms and conditions of any third-party services you use.

We reserve the right to suspend or terminate your account at any time, without prior notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, illegal, or abusive behavior
• Non-payment of fees
• Extended periods of inactivity
• Requests from law enforcement or regulatory authorities

Upon termination, your access to the Platform will cease immediately, and you will not be entitled to any refund of fees paid.

All content, software, code, designs, logos, and materials on the Platform are the exclusive property of Petrin Bertini Engineering and are protected by intellectual property laws. You may not:

• Copy, modify, distribute, or reverse engineer any part of the Platform
• Use our trademarks, logos, or branding without written permission
• Create derivative works based on the Platform

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Brazil.

For users outside Brazil: While dogabot operates internationally, the governing law remains Brazilian law. By using the Platform, you consent to this jurisdiction.

Before pursuing any legal action, you agree to first contact us at support@dogabot.com to attempt to resolve any disputes informally. If a dispute cannot be resolved within 30 days, either party may pursue formal legal proceedings.

We shall not be liable for any failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, labor disputes, internet or infrastructure failures, government actions, or pandemics.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice on the Platform at least 30 days before taking effect. Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, Refund Policy, and Disclaimer, constitute the entire agreement between you and Petrin Bertini Engineering regarding the use of the Platform and supersede all prior agreements and understandings.
